If a Driver Hits You While Walking or Running, We Can Help

In California, a significant percentage of the people killed in auto accidents are pedestrians. Catastrophic injury or death may occur when a person is struck by an automobile or where two vehicles collide near a pedestrian. Often motorists are found responsible in auto vs. pedestrian accidents. If a reckless or negligent driver injured you while you were walking, a skilled attorney from our San Jose office can help you recover damages for your medical bills, pain and suffering, and missed work.

Do Pedestrians Always Have the Right of Way in Colorado?

Though pedestrians generally have the right of way in marked and unmarked crosswalks, they still must act reasonably to protect their own safety. In accidents where a pedestrian is injured by a negligent driver, but did not act reasonably to protect his or her own safety, the total recovery might be reduced by the percentage the pedestrian is found to be at fault. This is called “comparative fault.” Examples may include:

  • A skateboarder jetting into the middle of a street without checking traffic
  • A jaywalker or someone crossing a street or highway in an unsafe location
  • A pedestrian sending text messages while crossing the street
  • A rollerblader listening to music on headphones, oblivious to honking horns

Even if you were partially at fault, California law does not prevent you from recovering at all. This is true in other types of cases such as motorcycle accidents and bus accidents as well.
